These Terms & Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and AiFitScan ("we", "us", "our", or "Company") regarding your use of the AiFitScan mobile application ("App", "Service", or "Application") available on Google Play Store.

Please read these Terms carefully before downloading, installing, accessing, or using the App. By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App and should uninstall it immediately.

1. About the App and Service

AiFitScan is an AI-powered fitness and nutrition tracking application that provides the following features:

• AI-Powered Meal Scanning: Scan meals using your device's camera to automatically identify food items and estimate nutritional information (calories, protein, carbohydrates, fats) using artificial intelligence.
• Calorie and Nutrition Tracking: Monitor your daily calorie intake, macronutrients (protein, carbs, fats), and track progress toward your nutrition goals.
• Weight Tracking: Record and monitor your weight over time to track progress toward your fitness goals.
• Daily Streaks: Build and maintain daily tracking streaks to stay motivated and consistent with your health goals.
• AI Coach: Chat with an AI-powered fitness coach to get personalized meal suggestions, nutrition advice, and motivation based on your profile and goals.
• Meal Planning: Receive personalized meal recommendations based on your dietary preferences, fitness goals, calorie targets, and available ingredients.
• Progress Monitoring: View your progress through visualizations, statistics, and insights about your nutrition and weight journey.

2. Eligibility and Age Requirements

By using the App, you represent and warrant that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction to use such services).
• If you are under the age of 18 (or the age of majority in your jurisdiction), you have obtained parental or guardian consent to use the App.
• You have the legal capacity and authority to enter into this Agreement.
• You are not prohibited from using the App under applicable laws or regulations.
• You will comply with all applicable local, state, national, and international laws and regulations when using the App.

If you do not meet these requirements, you must not use the App. We reserve the right to verify your age and eligibility at any time.

3. Account Registration and Security

To use certain features, you may need to create an account using Google Sign-In. You agree to:

• Provide accurate, current, and complete information during registration and profile setup
• Maintain and update your account information, including accurate fitness and preference data
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You are solely responsible for maintaining account security. We are not liable for loss or damage arising from your failure to protect your account. If you suspect unauthorized access, contact us at fit@tirovex.com.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use. You agree not to:

• Copy, modify, adapt, alter, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Rent, lease, lend, sell, sublicense, assign, distribute, or otherwise transfer the App or your rights to use it
• Use the App for any commercial purpose or in any way that violates applicable laws
• Use the App to transmit any malicious code, viruses, or harmful software
• Interfere with or disrupt the App, servers, or networks connected to the App
• Use automated systems (bots, scrapers) to access the App without permission
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5. User Obligations and Acceptable Use

You agree to use the App in a lawful, responsible, and appropriate manner. You agree:

• To provide accurate and truthful information in your profile, meal logs, and interactions with the App
• To use the App only for its intended purposes (fitness and nutrition tracking)
• Not to use the App in any way that could harm, disable, overburden, or impair our servers or networks
• Not to attempt to gain unauthorized access to the App, other users' accounts, or our systems
• Not to use the App to violate any applicable laws, regulations, or third-party rights
• Not to upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Not to use the App to spam, phish, or engage in any fraudulent or deceptive practices
• To respect the intellectual property rights of AiFitScan and third parties
• To comply with all applicable terms and policies of third-party services integrated with the App (Google, Firebase, etc.)

6. Camera Access and Meal Scanning

The App requires access to your device's camera to enable the AI-powered meal scanning feature. By granting camera permission, you agree that:

• You will only use the camera feature to scan meals for nutrition tracking purposes
• Meal images you capture are processed using third-party AI services (such as OpenAI or Google Gemini) to identify food items and estimate nutritional information
• Images are processed temporarily and are not stored on our servers unless you explicitly choose to save a meal entry that includes the image
• Processed meal metadata (meal name, calories, macros) may be stored in your account if you choose to save the meal
• You will not use the camera feature to capture inappropriate, illegal, or harmful content
• You understand that AI-powered meal recognition may have inaccuracies and should be used as a guide, not as definitive nutritional information

You can revoke camera permission at any time through your device settings, but this will disable the meal scanning feature.

7. AI-Generated Content and Services

AiFitScan uses third-party AI services (OpenAI, Google Gemini) to provide meal recognition, calorie estimation, AI coach conversations, and meal suggestions. AI-generated content is for informational purposes only and is NOT medical, nutritional, or health advice.

We do not guarantee the accuracy, completeness, or suitability of AI-generated content. AI meal recognition may misidentify foods or provide inaccurate estimates. Calorie and macro estimates are approximations. You should verify important nutritional information independently and consult qualified healthcare professionals before making significant dietary changes or health decisions.

When you use AI-powered features, your inputs (meal images, messages, profile data) may be sent to AI providers for processing according to their privacy policies. These providers may process your data temporarily for operational purposes such as safety and abuse monitoring. We do not share your data with AI providers for advertising purposes, and they do not use your data to train public models. See our Privacy Policy for more details.

Do not rely solely on AI-generated suggestions for medical or clinical decisions.

8. Third-Party Services and Integrations

The App integrates with various third-party services, including:

• Google Sign-In: For account authentication (subject to Google's Terms of Service)
• Firebase: For analytics, crash reporting, and backend services (subject to Firebase Terms of Service)
• Google Play Billing: For processing subscriptions and in-app purchases (subject to Google Play Terms of Service)
• AI Providers: OpenAI, Google Gemini, and other AI services for meal recognition and coaching (subject to their respective terms)
• Advertising Networks: We use third-party advertising services (such as Google AdMob) to display advertisements within the App. Your interaction with advertisements is subject to the respective advertising provider’s terms and policies.

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or policies of third-party services. We encourage you to review their terms and policies.

9. Subscriptions, Payments, and Refunds

AiFitScan offers optional paid subscriptions that unlock premium and unlimited features.

All purchases are processed securely through Google Play Billing. We do not collect or store your payment card details. Subscription payments, renewals, and billing are handled by Google Play in accordance with Google Play’s Terms of Service.

Subscriptions automatically renew at the end of each billing period unless cancelled through your Google Play account before the renewal date. You can manage or cancel your subscription at any time through the Google Play Store.

Refund requests are handled by Google Play and are subject to Google Play’s refund policies. We do not control or guarantee refund approvals.

We reserve the right to modify subscription pricing, features, or benefits at any time with reasonable notice.

10. Intellectual Property Rights

The App and all its content, features, code, graphics, and trademarks are owned by AiFitScan or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.

You retain ownership of content you create or submit (meal photos, profile info, messages). By uploading such content, you grant us a limited, non-exclusive, royalty-free license to store, use, and process the content solely to provide, operate, and improve the Service (including sending to AI providers strictly for the purpose of generating responses). This license is revocable by deleting your account; deletion will stop further use but copies may remain in backups for a limited period as described in our Privacy Policy.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, secure, or free from viruses or harmful components
• Warranties regarding the accuracy, reliability, or completeness of any content, information, or features
• Warranties that defects will be corrected
• Warranties regarding third-party services or integrations

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:

• Loss of profits, revenue, data, or use
• Loss of business opportunities or goodwill
• Cost of substitute services
• Damages arising from your use or inability to use the App
• Damages arising from errors, inaccuracies, or omissions in the App or AI-generated content
• Damages arising from unauthorized access to or alteration of your data
• Damages arising from reliance on AI-generated information or recommendations

Our total liability for all claims arising from or related to the App shall not exceed the amount you paid us (if any) in the 12 months preceding the claim. If you have not paid anything, our liability is limited to a nominal amount (e.g., $10 USD or local currency equivalent) where permitted by law.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless AiFitScan, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights (including intellectual property or privacy rights)
• Your content or any content you submit through the App
• Your reliance on AI-generated content or recommendations

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

14. Termination

You may stop using the App at any time by uninstalling it or deleting your account through the App or by contacting us at fit@tirovex.com.

We may suspend or terminate your access at our discretion for violation of these Terms, fraudulent activity, misuse, or any other reason. Upon termination, your right to use the App will cease, we may delete your account and data, and you will not be entitled to refunds except as required by applicable law or Google Play policies. Provisions that should survive termination (including Sections 10-13) will continue to apply.

How to delete your account: Go to Profile → Settings → Delete Account in the App, or contact us at fit@tirovex.com. Once you request deletion, your account and associated data will be removed from our active systems within approximately 30 days. Some data may remain in backups for up to 90 days or as required by law or third-party provider policies.

15. Changes to These Terms

We reserve the right to modify, update, or change these Terms at any time, at our sole discretion. We will notify you of material changes by:

• Updating the "Last updated" date at the top of these Terms
• Posting a notice in the App
• Sending an email notification (if you have provided your email address)

Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App and delete your account.

We encourage you to review these Terms periodically to stay informed about any updates.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in India, unless otherwise required by applicable law. Before filing a legal claim, contact us at fit@tirovex.com to attempt informal resolution. If unresolved within 60 days, you may proceed with formal proceedings.

17. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid, the remaining provisions continue in effect. Our failure to enforce any right does not constitute a waiver. You may not assign these Terms without our consent; we may assign them freely. We are not liable for failures due to circumstances beyond our control (natural disasters, internet outages, third-party service failures, etc.).

18. Health and Medical Disclaimer

AiFitScan is designed for fitness and wellness support and is NOT a medical device, medical service, or healthcare provider. The App provides:

• Tools for tracking nutrition, calories, and weight
• AI-powered meal scanning and calorie estimation (which may have inaccuracies)
• AI-generated meal suggestions and coaching (for informational purposes only)
• Progress monitoring and visualization tools

The App does NOT provide medical, nutritional, or health advice, diagnosis, or treatment. The content, features, and AI-generated information are not substitutes for professional medical consultation, diagnosis, or treatment.

Always seek the advice of qualified healthcare providers, registered dietitians, or nutritionists before:

• Making significant dietary changes
• Starting a new weight loss or weight gain program
• Making decisions about medical conditions or treatments
• If you have health conditions, allergies, or specific nutritional needs
• If you are pregnant, nursing, or have a medical condition

Do not disregard professional medical advice or delay seeking it because of information provided by the App. If you have a medical emergency, contact your local emergency services immediately.

You acknowledge and agree that:

• You use the App at your own risk
• We are not responsible for any health outcomes resulting from your use of the App
• AI-generated nutritional information may be inaccurate and should be verified independently
• You should consult healthcare professionals for personalized medical and nutritional advice
